1. Who we are
DataFloem ("we", "us") is the data controller for the personal data collected on datafloem.com (the "Site"), within the meaning of the Turkish Personal Data Protection Law No. 6698 ("KVKK") and, where it applies, the EU General Data Protection Regulation ("GDPR"). This policy covers the Site only. Data processed inside a DataFloem installation is controlled by the organization that runs it.
2. What we collect
We collect personal data only when you send one of the Site's forms:
- Book a Demo: your name, email address and company, and, if you give them, your phone number and a message.
- Contact Us: your name, email address, subject and message, and, if you give them, your company and phone number.
- Developer Edition sign-up: your email address.
With every form we also store the language of the page it was sent from, the time it was sent, and the approximate location of your connection (country, region, city and time zone) as Cloudflare derives it from your IP address. We do not store the IP address itself.
Browsing the Site does not require you to give us anything. We do not run analytics or advertising scripts, and we do not build profiles of visitors.
3. Why we use it, and on what legal basis
- To arrange the demo you asked for and follow up on it: taking steps you requested before a possible contract (KVKK Art. 5(2)(c); GDPR Art. 6(1)(b)).
- To answer your message: our legitimate interest in replying to people who write to us (KVKK Art. 5(2)(f); GDPR Art. 6(1)(f)).
- To tell you when Developer Edition is released: you asked to be told, and we send nothing else to that list (KVKK Art. 5(2)(f); GDPR Art. 6(1)(a), your consent, which you can withdraw at any time).
- To keep the forms free of spam and abuse, and to understand which countries and regions interest in DataFloem comes from: our legitimate interest in running a secure Site and planning our work (KVKK Art. 5(2)(f); GDPR Art. 6(1)(f)).
- To meet legal obligations and to establish, exercise or defend legal claims, where needed (KVKK Art. 5(2)(ç) and (e); GDPR Art. 6(1)(c) and (f)).
We do not sell your personal data, and we do not use it for automated decisions that affect you.
6. Transfers abroad
Cloudflare runs a global network, so your data may be processed and stored on servers outside Türkiye, including in the United States and the European Union. We make these transfers under Article 9 of KVKK and, for data covered by the GDPR, under its Chapter V, relying on the safeguards our service provider offers, such as standard contractual clauses.
7. How long we keep it
- Demo requests and messages: as long as we need them to handle your request and any business relationship that follows, and after that only as long as the law requires or a legal claim may arise. Then we delete or anonymize them.
- Developer Edition sign-ups: until we have announced the release, or until you ask us to remove your address, whichever comes first.
8. Your rights
Under Article 11 of KVKK you have the right to:
- learn whether we process your personal data and, if we do, request information about it;
- learn the purpose of the processing and whether the data is used for that purpose;
- know the third parties, in Türkiye or abroad, to whom it is transferred;
- ask us to correct it if it is incomplete or wrong, and to delete or destroy it under the conditions in Article 7 of KVKK;
- ask us to tell the third parties it was transferred to about a correction or deletion;
- object to a result against you that arises only from automated analysis of your data;
- claim compensation if you suffer damage from unlawful processing.
If the GDPR applies to you, you also have the rights of access, rectification, erasure, restriction, data portability and objection, and the right to withdraw consent at any time without affecting earlier processing.
To use any of these rights, write to us at info@datafloem.com or send a letter to Atatürk Mah. Ertuğrul Gazi Sk. Metropol İstanbul Sitesi C1 Blok Kat:23, Ataşehir / İstanbul, Türkiye, with enough detail for us to identify you and your request. We answer within 30 days at the latest. If you are not satisfied with our answer, you can complain to the Turkish Personal Data Protection Board (Kişisel Verileri Koruma Kurulu) or, under the GDPR, to the data protection authority where you live or work.
9. Security
The Site is served over HTTPS, the database is not reachable from the internet, and access to what you send is limited to the people who need it. No system is perfectly secure, but we take reasonable technical and organizational measures to protect your data.
10. Children
The Site is meant for professionals and is not directed at children. We do not knowingly collect personal data from anyone under 16. If you believe a child has sent us their details, write to us and we will delete them.
11. Changes to this policy
We will update this policy when what we collect or how we use it changes. The date at the top of this page shows the latest version.
